The monitoring agency can trace all the phone records and email records. They can find unusual transactions. For example, if people live in the same zip code suddenly buying large volume of certain securities, they can suspect that there is a securities dealer living in the close proximity passing out insider information. Unless the hard drive is destroyed, people can restore data already deleted. The best advice is DO NOT DO IT. It is not fair to the average investors.
People working at executive level of public companies or, people like Ms. Wang having insider knowledge, should not engage in those activities. Of course, there are insiders doing these things every day. Legal system can only prosecute a tiny number of these people, like Martha Stewart's case. This case just happens to be involving a Chinese citizen. She probably will be barred from engaging in securities business for the rest of her life.
There were people wrongly accused, of course. I personally think Mike Milken was not seriously criminally involved. However, at the time, the financial establishment could not tolerate him. (If I remember right, Rudy was the prosecutor).
