chinese judicial system is totally different from the american one, as the chinese judicial system is yet in process of integration and transformation as the society is.
american judicial system is much more matured based on it current capitalist society. yet, legislations are to introduce every once in a while to strike the new balance reflecting the changes in values of the times in correposnding societies
for example, back in the times of great depressions in usa, the legislations over many aspects were not in place to prevent certain social behaviors from happening by defined as crimes. so after that, the legislations were introduced in the 30's. many security market foundation today learnt the lessons and is now more integrated and matured.
then, the blacks were segregated until the legislations introduced for integrated schools in the 70's. that reflected the changes in values.
then we have equal right regarding different sex, the legislation again introduced new legal grounds
now, about the gay/lesbian rights, not sure most of the americans under the right wing christian government can accept what is accepted by dutch and other european countries....we will see how american legislation adjust to that
now let's look at chinese legislations. from 80's, zhao ziyang's regime introduced at amazing speed many legal frame works for the country to turn it into a program pushing the country towards rule of law. the society transformed significantly and the legislation of course had a lot to catch up when the values significantly changed in the society.
but the prob is not about legislation. many of my former classmates are today practicing as lawyers in china, the dark inside news came to me seems to suggest that china will have a long way to go to enforce the laws with true justice served, regardless what legislation is introduced.
when the judges and the police,inspectors are taking pay checks from the same rice bowls, you know they will cover each tohers asses, and the people will be screwed for sure.
