Patent pooling itself is legal. It is actually convenient for licensees to negotiate licensing agreements with a single entity instead of with individual patent owners.
However, if a patent pool is anti-competitive in nature, it could violate US anti-trust law ( 反垄断法). For example, it is illegal to bundle non-essential patents with essential patents, charge unreasonable royalty fees, or have discriminatory licensing policies.
In this case, the Chinese manufacturers are alleging that the 3C fixed floor price of $5/player is unreasonable given the sharp price reduction of DVD players in recent years. Now the patent royalty is approximately 25 per cent of a DVD player's manufacturing cost and the Chinese manufacturers are arguing that the fixed price floor is not competible with the natural market depreciation of DVD technology over time.
