ITC casts final US-Sino tariff decision

The U.S. International Trade Commission (ITC) has cast the final decision in the U.S.-Sino AD and CVD photovoltaic trade case, thus bringing to an end the U.S. leg of the tariff debate. Unsurprisingly, it has voted in favor of tariffs.
A final decision has been reached regarding photovoltaic imports from China into the US.

Following more than a year of investigations and name calling from both sides of the fence, the U.S. ITC has finally brought to a close the U.S.-Sino anti-dumping (AD) and countervailing duty (CVD) trade case. In a statement on its website, the ITC wrote today, "The U.S. International Trade Commission has made affirmative determinations in its final phase antidumping and countervailing duty investigations concerning Crystalline Silicon Photovoltaic Cells and Modules from China."
While the ITC is still to issue further details (according to the website, these will be available three hours after the decision has been met), based on the information released at the time the U.S. Department of Commerce (Commerce) made its final determination, Chinese manufactures have been found guilty of importing crystalline silicon photovoltaic cells and modules into the U.S. at dumping margins of between 18.32 and 249.96%, and that they have received countervailable subsidies of 14.78 to 15.97%.
As such, it is expected that Commerce now has the go ahead to issue AD and CVD orders. See the table below for an overview of the tariffs:

The ITC is still to vote on the "critical circumstances" issue. If they are found to have existed in the AD investigation, provisional duty deposits – normally collected as of the date of publication in the Federal Register (May 25, 2012) of Commerce’s preliminary determinations – will be collected 90 days prior to that date from all companies except Wuxi Suntech. AD deposits applied to Wuxi Suntech will also be due as of the date of publication of Commerce’s preliminary determination.
It is also still to decide if critical circumstances were found in the CVD case. If affirmative, duties will be retroactively applied to all Chinese photovoltaic cell and module imports that entered the U.S. beginning December 3, 2011.
As a result of the final AD determination, and based on information at the time of Commerce's final decision, Commerce will instruct U.S. Customs and Border Protection (CBP) to collect cash deposits or bonds equal to the applicable weighted-average dumping margins. Meanwhile, as a result of the affirmative final CVD determination, Commerce is expected to order the resumption of the suspension of liquidation and require a cash deposit equal to the final net subsidy rates.
Photovoltaic modules, laminates, and panels produced in a third-country from cells produced in the China were are covered by the investigation.
Industry reaction
Responding to the news, CASE president, Jigar Shah stated, "Today’s expected decision by the ITC marks the end of a distracting and politically-charged trade case between the U.S. and China regarding imports of solar cells. Although this ruling was anticipated given the ITC’s low threshold for injury determinations, we are nevertheless disappointed that they have left in place the Commerce Department’s tariffs on solar cell imports. Fortunately, the scope of the decision is unchanged and is limited to solar cells produced in China, thereby minimizing harm to the U.S. solar industry."
He added, "We will continue to encourage dialogue and negotiation between the U.S. and Chinese governments to seek a constructive resolution. Unilateral tariffs and a trade war in today’s interconnected global marketplace are unnecessary and detrimental to effective and efficient business competition. Going forward, we must avoid a repeat of the SolarWorld saga, as the growth of the solar industry here, in Europe, and around the world is too important to be upended by one company’s self-serving crusade."
